Course Access and Intellectual Property Agreement

(Also known as the Course Access and Confidentiality Agreement)

Introduction

By enrolling in this course, you agree to the following terms governing your access to and use of its materials. These terms protect the original content, integrity, and educational value of the course created by Aaron Gascoyne and Kayak Ontario.

1. Confidential Course Content

All written lessons, videos, graphics, images, diagrams, downloads, and other materials provided in this course are the confidential and copyrighted property of Aaron Gascoyne and Kayak Ontario.

While the course may reference widely recognized paddling principles and public-domain knowledge, the presentation, structure, design, and original instructional materials are proprietary and protected under copyright law.

2. Permitted Use

You are granted a personal, non-exclusive, non-transferable license to access and use the course materials for your own educational purposes.

You may view and download content for private reference only. This license remains valid for as long as you have active access to the course. No ownership or intellectual property rights are transferred to you through purchase or enrollment.

3. Prohibited Actions

To protect the integrity of the course, you agree not to:

• Copy, record, reproduce, or distribute any course materials in any format.

• Share your login credentials or provide course access to any other individual, group, or organization.

• Upload course content to any online platform, social media site, or file-sharing service.

• Use any portion of the course for commercial purposes, instruction, or publication without prior written consent from the author.

• Rebrand, alter, modify, or present any course materials as your own work.

• Use, upload, or input course content into any artificial intelligence system or dataset for the purpose of analysis, reproduction, or derivative work.

• Reverse-engineer or replicate the design, structure, or assessment framework of the course for the creation of competing materials.

4. Intellectual Property Ownership

All intellectual property rights remain exclusively with Aaron Gascoyne and Kayak Ontario.
This includes all written lessons, diagrams, videos, course design, structure, and assessments.

Purchasing or enrolling in the course grants you a license to access the materials — it does not confer ownership or any right to reproduce or redistribute them.

5. Intellectual Property Scope

This course draws on established sea kayaking practices, safety principles, and navigation techniques that are broadly recognized within the paddlesports community. Aaron Gascoyne and Kayak Ontario make no claim of ownership over the general methods or concepts described.

All intellectual property rights apply solely to the original creative elements — including written lessons, course layout, video instruction, assessment design, and supporting graphics — which remain protected under Canadian and international copyright law.

Videos from Online Sea Kayaking are included with permission and remain the exclusive property of their respective creators.

6. Consequences of Breach

Any unauthorized use, reproduction, distribution, or sharing of course content constitutes a violation of this agreement.

Consequences may include, at the discretion of the authors:

• Immediate termination of course access without refund,

• Revocation of certification or completion records, and

• Legal action under applicable copyright and intellectual property law.

7. Acknowledgment and Acceptance

By purchasing or accessing this course, you acknowledge that you have read, understood, and agree to comply with all terms of this Course Access and Intellectual Property Agreement.

Accessing or using any portion of the course constitutes your acceptance of these terms.

This agreement is governed by the laws of Ontario, Canada.
